A Bride’s Package in the Light of Islamic Law and the ‎Personal Status Law

يهدف هذا البحث إلى تقديم دراسة عن جانب من جوانب حقوق الزوجة في مسائل الأحوال الشخصية. وقد مهدت لهذه الدراسة ببيان مبدأ مشروعية المهر في الإسلام وحق المرأة فيه وفي تهيئة المسكن الملائم للحياة الزوجية. وتناول البحث إظهار عقبات الزواج وطرق معالجتها في ضوء الإسلام وقد حاولت خلال الدراسة التعرض لقضايا الجهاز ومسائله والمنازعات التي تقع فيه، والعرف الجاري في بعض المناطق بشأنه، وحكم (الدوطة) عند غير المسلمين. وخلص البحث إلى الدعوة للقضاء على الأعراف الفاسدة والتقاليد السائدة التي لا توافق أحكام الشرعية، وتم رصد أهم النتائج التي توصل البحث إليها.

This research aims at introducing a study of one side of the rights of wives in the personal status law. We have introduced this study with the lawfulness of the dowry in Islam and the rights of women in getting a dowry and a dwelling suitable for matrimonial life. The study also highlights the obstacles that encounter marriage and ways of dealing with them according to Islamic faith. It also undertakes the issue of a bride’s package, its problems, disputes and its traditional norms in same areas; it also deals with the law governing on bride’s package (dota) for nonmuslims. The research concludes with a call for revoking the dominant traditions which do not agree with the Islamic law, and with the major results that the research arrives at.
